    Common Reasons Why Social Security Disability Claims Are Denied

    Last updated 5 months ago

    If you are physically or mentally disabled, you may be eligible for an income supplement from the government, administered by the Social Security Administration. Completing the necessary paperwork and procedures can be complicated, and qualified individuals may be denied when they initially apply due to simple mistakes. Contact a Social Security attorney to avoid these common reasons for denial:

    Lack of Medical Evidence
    Medical records are essential for the Social Security Administration to grant you disability benefits. If you have not sought medical treatment or there is no recorded evidence of your disability by a medical professional, your claim for benefits is likely to be denied. Additionally, you must be willing to release all of your medical records to the Administration, and you may be required to submit to a consultative examination, paid for by the government.

    Severity of Disability
    Though you may be suffering, the Administration must find that your impairment is severe enough to warrant disability benefits. Your impairment must be likely to last at least 12 months to be considered severe.

    Failure to Follow Therapy
    You must follow your doctor’s prescribed therapy and treatment plan to be eligible for disability benefits. There are limited circumstances which will excuse you from following the doctor’s prescribed therapy; if you do not have an acceptable excuse, you will be denied benefits.

    Claimant’s Income
    You may be able to work minimal hours, but there are strict guidelines for how much employment income you are allowed to earn. If you are above the limit, this is known as “substantial gainful activity” and the government will not consider you disabled.

    Build Your Understanding of Workers' Compensation

    Last updated 5 months ago

    Have you been hurt on the job? You may have grounds for a workers’ compensation claim that entitles you to receive income replacement payments, and in some cases, monetary awards as well.

    The workers’ compensation system provides for benefits without having to file a lawsuit against your employer. Possible benefits include medical care, disability compensation, and vocational rehabilitation and training. Workers’ compensation is a no-fault system, meaning that negligence is typically not an issue and the fact that an injury occurred is sufficient for compensation. However, your own intentional acts, such as intoxication, will disqualify you from benefits. Watch this video for more information.

    To ensure that your rights are protected, contact a personal injury attorney at Jay Trucks & Associates by calling (989) 644-0166.

    Defining Third Parties as They Pertain to Personal Injuries

    Last updated 5 months ago

    Personal injury law is a broad field that includes auto accidents, premises liability, dog bites, wrongful death, and more. If you are injured, or if a loved one is fatally injured, due to another person’s negligence, you may have a personal injury claim. It is also possible for a third party to be liable for your injuries even if they were not present at the scene of the accident or even aware of it. The following are common examples of third parties who may be liable in such cases:

    Automobile Accidents

    Car accident liability usually involves only the parties to the accident, which is one reason why Michigan requires every car owner to have no-fault insurance to pay for medical bills, lost wages, and more. However, there can be third parties who are liable for your injuries as well, such as a city that fails to properly maintain its streets or traffic signals.

    Trucking Accidents

    Truck accidents can be much more complicated than car accidents. In addition to the truck driver, the truck owner, manufacturer, and brokerage company may all be liable for your injuries. These parties can be held liable if they were responsible for malfunctioning equipment, improper staffing, or poorly designed routes.

    On-the-Job Accidents

    If you have been injured in a workplace accident, you are likely eligible to file for workers’ compensation. However, if a third party is liable for your injuries, you may be able to file suit against that party in addition to claiming workers’ compensation. One common example of such parties is a manufacturer who has produced defective equipment that is in use at your place of employment.

    If you have been the victim of a personal injury, contact an attorney to discuss your rights. The personal injury attorneys at Jay Trucks & Associates are dedicated to helping Michigan residents with personal injury cases involving an auto accident, truck accident, dog bite, etc. To learn how we can help, call (989) 644-0166.

    On Tuesday, AAJ will launch Take Justice Back—a grassroots campaign to let everyday Americans know why they should care about protecting the civil justice system.

    We are out-spent by corporations that try to limit consumer rights, but we have the truth on our side.

    Take Justice Back will:
    EDUCATE people on how their rights are being threatened;
    MOTIVATE Americans by sharing real stories of people denied justice;
    ENGAGE consumers through social media such as blogs, Facebook, and Twitter; and
    EMPOWER activism by creating a portal where people can share information, send letters to members of Congress, sign petitions, and link through to their own blogs.

    Here’s what you can do:

    • Link to Take Justice Back on your website, Twitter and Facebook pages.
    • Add the TJB logo to your signature block, on blogs and websites.

    • Write about TJB in your firm newsletter (or on your blog) and provide the TJB email address for readers to learn more: www.TakeJusticeBack.com
    • Send AAJ a blog post on a state issue related to the injustices of “tort reform.” If selected, we can use your blog on TJB and link to your website/blog. Send blogs to AAJ’s Communications Director: Christopher.Scholl@justice.org.

    Take a stand and be involved. We have the right message. Now it’s time to spread the word. Please join me in doing all you can to Take Justice Back.
